In many divorce and custody appeals the entire appeal is based on the appellate court judge closely reviewing the legal briefs filed by each party.
What is an initial brief?
The initial brief is the brief that is filed by the person who is seeking to have the trial court’s decision overturned. This will be the first brief filed in the case.
It is important to note that if an issue is not raised in the initial brief than the appeal of the issue is waived. For this reason, it is imperative that the initial brief be well written and inclusive of everything being appealed.
